Terms and Conditions

Article 1 — Definitions

1.1 In these terms and conditions, the following definitions apply

a. DJ / Service Provider: Break Rules Enjoy / L2PM ;

b. Client: the individual or legal entity entering into an agreement with the DJ for a performance or musical services;

c. Agreement: the verbal or written arrangement between the DJ and the Client regarding one or more performances;

d. Performance: the DJ services provided on an agreed date, time and location.

Article 2 — Applicability

2.1 These terms apply to all quotes, agreements and performances provided by the DJ, whether for weddings, private parties, club nights, festivals or other events.

2.2 Deviations from these terms are only valid if agreed in writing.

2.3 Any purchasing or other terms and conditions of the Client are expressly rejected.

Article 3 — Formation of the Agreement

3.1 An agreement is formed once the Client has accepted the DJ's quote or booking confirmation in writing (including by email), or once a deposit has been received.

3.2 The booking confirmation will at minimum state: date, location, start and end time, fee, and any special arrangements regarding equipment.

Article 4 — Fee and Payment

4.1 Upon booking, the Client owes a deposit of 25% of the agreed fee, payable within 14 days of the booking confirmation.

4.2 The remaining balance of the fee is due no later than 1 day before the performance, unless otherwise agreed in writing.

4.3 In case of late payment, the Client is automatically in default and the DJ is entitled to charge statutory interest and reasonable collection costs.

4.4 Travel costs, accommodation costs and any additional costs (such as rental of extra equipment) are discussed in advance and, unless otherwise agreed, are borne by the Client.

Article 5 — Cancellation

5.1 Cancellation by the Client must be made in writing. Depending on the timing of cancellation, the following cancellation fees apply as a percentage of the agreed fee:
• More than 4 weeks before the performance: 10% of the fee;
• Between 4 and 2 weeks before the performance: 50% of the fee;
• Within 2 weeks of the performance: 100% of the fee.

5.2 Deposits already paid will not be refunded in the event of cancellation by the Client.

5.3 If the DJ cancels the performance due to force majeure (see Article 8), the DJ will make reasonable efforts to arrange an equivalent replacement. If no replacement can be arranged, the deposit will be refunded, without the Client being entitled to any further compensation.

Article 6 — Equipment and Technical Requirements

6.1 It will be agreed in advance, per performance, whether the DJ brings his own equipment or whether the Client or venue will provide suitable DJ equipment, sound and lighting.

6.2 If the venue provides the equipment, it must be set up and tested no later than 4 hours before the start. Delays or failures resulting from defective venue equipment are at the Client's risk and expense.

6.3 The Client is responsible for providing a suitable, dry and safe setup location, sufficient power supply, and timely access to the venue for setup and soundcheck.

6.4 Damage to the DJ's own equipment caused by third parties or by circumstances at the venue may be recovered from the Client or the party responsible.

Article 7 — Client Obligations

7.1 The Client will provide timely and complete information regarding the venue, audience, desired music programme and any special requirements.

7.2 The Client will ensure that the DJ can carry out the work undisturbed and safely.

7.3 Changes to times, location or programme must be communicated to the DJ as soon as possible, and no later than [number] days in advance.

Article 8 — Force Majeure

8.1 Force majeure includes, among other things: illness, accident, traffic disruptions, extreme weather conditions, government measures, and other circumstances that cannot reasonably be attributed to the DJ.

8.2 In the event of force majeure, the DJ is not obliged to perform the agreement, nor to pay any compensation, without prejudice to Article 5.3.

Article 9 — Liability

9.1 The DJ is only liable for direct damage that is the direct result of intent or gross negligence on the part of the DJ.

9.2 The DJ's liability is at all times limited to the amount of the fee agreed for the relevant performance.

9.3 The DJ is not liable for damage caused by defects in equipment, sound systems or facilities provided by the Client or the venue.

9.4 Any liability for consequential damage, loss of profit or non-material damage is excluded, to the extent permitted under applicable law.

Article 10 — Music Rights

10.1 The Client is responsible for any required payment of copyright and related rights (such as licensing fees to the relevant collecting society) at the venue of the performance, unless otherwise agreed in writing.

Article 11 — Photo, Video and Audio Recordings

11.1 Photos and videos of the performance made by or on behalf of the Client may only be used for the DJ's promotional purposes with the DJ's prior consent.

11.2 Unless otherwise agreed, the DJ may use photo, video and audio material of the performance for his own promotional purposes (such as website and social media).

Article 12 — Complaints

12.1 Complaints regarding the performance of the agreement must be submitted to the DJ in writing and with reasons as soon as possible, and no later than [number] days after the performance.

Article 13 — Governing Law and Disputes

13.1 These terms and conditions, and all agreements between the DJ and the Client, are governed by the laws of the Netherlands, unless otherwise agreed in writing.

13.2 Disputes will be resolved through mutual consultation wherever possible. If parties cannot reach agreement, the competent court in the district where the DJ is established has jurisdiction, unless mandatory law provides otherwise.

Article 14 — Final Provisions

14.1 If any provision of these terms is found to be invalid or is annulled, the remaining provisions will remain in full force.
